By accessing or using ExpandNote (the "Service"), operated by Altitude Information Systems LLC ("we", "our", or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

ExpandNote is an AI-powered note-taking application that provides note creation and management, real-time sync across devices, AI-powered content processing via configurable AI Profiles, voice-to-text input, email-to-note functionality, and version history. The Service is available as a web application and mobile application for iOS and Android.

3. User Accounts

To use the Service, you must create an account. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access
  • Ensuring your account information is accurate and up to date

4. User Content

You retain full ownership of all content you create using the Service, including notes, tags, and any other user-generated content ("User Content").

By using the Service, you grant us a limited license to store, sync, and process your User Content solely for the purpose of providing the Service to you. We will not use your content for any other purpose, including training AI models.

You are responsible for ensuring your User Content does not violate any laws or third-party rights.

5. AI Features

The Service offers AI-powered features through AI Profiles. When using these features:

  • You must provide your own API keys for the AI providers you wish to use (OpenAI, Anthropic, or OpenRouter)
  • Your note content is sent to the selected AI provider for processing
  • AI-generated output is provided "as is" and we make no guarantees about its accuracy, completeness, or suitability
  • You are responsible for reviewing AI-generated content before relying on it
  • Usage of AI providers is subject to their respective terms of service and pricing

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Store or transmit malicious code or harmful content
  • Attempt to gain unauthorized access to other users' data
  • Interfere with or disrupt the Service or its infrastructure
  • Use the Service for any illegal or unauthorized purpose
  • Reverse engineer, decompile, or disassemble any part of the Service

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in the Privacy Policy.

8. Intellectual Property

The Service, including its design, code, features, and branding, is owned by Altitude Information Systems LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works of any part of the Service without our prior written consent.

9. Service Availability

We strive to maintain high availability of the Service. However, we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our control. The offline-first architecture ensures you can continue working with locally cached data during outages.

10. Limitation of Liability

To the maximum extent permitted by law, Altitude Information Systems LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claims arising under these terms shall not exceed the amount you paid us in the twelve months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.

12. Termination

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Service if you violate these terms or for any other reason at our discretion, with reasonable notice when possible.

Upon termination, your right to use the Service ceases immediately. We will retain your data for 30 days after termination to allow you to export your content, after which it will be permanently deleted.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law principles. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.

14. Changes to These Terms

We reserve the right to modify these terms at any time. We will notify you of material changes by posting the updated terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the revised terms.
